Terms of Use

The terms on which you use Willkeeper, and the important limits of what we do.

Last updated: [insert date]

Please read before publishing. These terms are a starting template, not legal advice. Have them reviewed and adapted by a qualified Australian legal practitioner — particularly the disclaimer, liability, and refund sections — before you rely on them.

These Terms of Use govern your use of the Willkeeper website and services, provided by LEGAL CARE AUSTRALIA PTY LTD (ABN 12 162 902 543) ("we", "us", "our"). By using the site, you agree to these terms. If you don't agree, please don't use the service.

1Important disclaimer — not legal advice

Willkeeper is a self-help tool that helps you prepare will documents using structured questions and templates. We are not a law firm and we do not provide legal advice. Using Willkeeper does not create a solicitor–client relationship, and nothing on this site is a substitute for advice from a qualified legal practitioner.

If your circumstances are complex — for example a blended family, a business, a trust, overseas assets, or a will you expect to be contested — you should obtain advice from a Western Australian solicitor before proceeding.

2Eligibility

To make a will using Willkeeper you must be at least 18 years old and have the legal capacity to make a will. The service is designed for wills governed by the law of Western Australia.

3Your responsibilities

4No guarantee of outcome

While our templates are prepared with care to reflect WA requirements, we cannot guarantee that a will produced through the service will be valid or suitable for your specific circumstances, particularly where those circumstances are complex or where the document is not signed and witnessed correctly.

5Fees, payment & refunds

Fees are shown on the site and payable as described at the time of purchase. [Insert your refund policy — e.g. cooling-off period, conditions for refunds.] Nothing in these terms limits rights you have under the Australian Consumer Law.

6Intellectual property

The Willkeeper website, its content, and its templates are owned by us or our licensors and are protected by law. You may use them only to prepare your own will. You retain ownership of the information you provide.

7Limitation of liability

To the extent permitted by law, and subject to the Australian Consumer Law, we are not liable for any loss arising from your use of the service, including loss resulting from incorrect information, incorrect signing or witnessing, or reliance on the service in place of professional legal advice. [Confirm wording with your solicitor.]

8Governing law

These terms are governed by the laws of Western Australia, and you submit to the non-exclusive jurisdiction of the courts of Western Australia.

9Changes to these terms

We may update these terms from time to time. The current version will always be posted on this page with its "last updated" date.
